Bir ki\u015finin tutuklanabilmesi i\u00e7in:<\/p>\n<ul>\n<li><strong>Kuvvetli su\u00e7 \u015f\u00fcphesinin bulunmas\u0131<\/strong>,<\/li>\n<li><strong>Tutuklama nedenlerinin varl\u0131\u011f\u0131<\/strong>,<\/li>\n<li><strong>Adli kontrol tedbirlerinin yetersiz olmas\u0131<\/strong> gerekmektedir.<\/li>\n<\/ul>\n<p>Ancak, tutuklama ge\u00e7ici bir tedbirdir ve belirli hallerde sona erebilir.<\/p>\n<h3><strong>2. Tahliye talebinin kabul edilebilmesi i\u00e7in:<\/p>\n<ul>\n<li>Tutuklama \u015fartlar\u0131n\u0131n ortadan kalkmas\u0131,<\/li>\n<li>Delil karartma veya ka\u00e7ma \u015f\u00fcphesinin olmamas\u0131,<\/li>\n<li>Adli kontrol tedbirlerinin yeterli olmas\u0131 gerekir.<\/li>\n<\/ul>\n<h4><strong>b) Tutukluluk S\u00fcresinin Dolmas\u0131<\/strong><\/h4>\n<p>CMK m. 102\u2019ye g\u00f6re, tutukluluk belirli s\u00fcrelerle s\u0131n\u0131rl\u0131d\u0131r:<\/p>\n<ul>\n<li><strong>A\u011f\u0131r ceza gerektirmeyen su\u00e7larda<\/strong> en fazla <strong>1 y\u0131l<\/strong>,<\/li>\n<li><strong>A\u011f\u0131r ceza gerektiren su\u00e7larda<\/strong> en fazla <strong>2 y\u0131l<\/strong> (istisnai durumlarda 3 y\u0131la kadar uzat\u0131labilir).<\/li>\n<\/ul>\n<p>Bu s\u00fcre doldu\u011funda, mahkeme taraf\u0131ndan serbest b\u0131rak\u0131lmas\u0131 gerekir.<\/p>\n<h4><strong>c) Adli Kontrol Karar\u0131 ile Serbest B\u0131rak\u0131lma<\/strong><\/h4>\n<p>Mahkeme, tutuklunun serbest b\u0131rak\u0131lmas\u0131na karar verirken adli kontrol \u015fartlar\u0131n\u0131 uygulayabilir. E\u011fer itiraz kabul edilirse, tutukluluk karar\u0131 kald\u0131r\u0131larak ki\u015fi serbest b\u0131rak\u0131l\u0131r.<\/p>\n<h3><strong>3. Tutukluluk Karar\u0131na \u0130tiraz Nas\u0131l Yap\u0131l\u0131r?<\/strong><\/h3>\n<ul>\n<li><strong>Sulh Ceza Hakimli\u011finin verdi\u011fi tutuklama karar\u0131na<\/strong> 7 g\u00fcn i\u00e7inde itiraz edilebilir.<\/li>\n<li>\u00dcst mahkeme, delilleri de\u011ferlendirerek itiraz\u0131 kabul edebilir ve serbest b\u0131rakma karar\u0131 verebilir.<\/li>\n<\/ul>\n<p>Tutukluluk, hukuk sisteminde ge\u00e7ici bir tedbirdir ve \u00e7e\u015fitli yollarla sonland\u0131r\u0131labilir. Tahliye talebi, adli kontrol, beraat veya s\u00fcrenin dolmas\u0131 gibi hukuki mekanizmalar, tutuklular\u0131n serbest kalmas\u0131n\u0131 sa\u011flayabilir.
