olmaks\u0131z\u0131n yaln\u0131zca kullanmak i\u00e7in bulundurmas\u0131 durumunda i\u015flenen su\u00e7tur.<\/p>\n<p><strong>Cezas\u0131:<\/strong><\/p>\n<ul>\n<li>2 y\u0131ldan 5 y\u0131la kadar hapis cezas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/li>\n<li>Ancak, ilk kez su\u00e7 i\u015fleyen ki\u015fi hakk\u0131nda <strong>kamu davas\u0131n\u0131n a\u00e7\u0131lmas\u0131n\u0131n ertelenmesi (KDE)<\/strong> karar\u0131 verilebilir.<\/li>\n<\/ul>\n<h3><strong>b) Uyu\u015fturucu Madde Ticareti Yapmak (TCK 188)<\/strong><\/h3>\n<p>Uyu\u015fturucu veya uyar\u0131c\u0131 maddeyi satmak, ba\u015fkalar\u0131na vermek, nakletmek, \u00fcretmek ya da ticaretini yapmak su\u00e7tur.<\/p>\n<p><strong>Cezas\u0131:<\/strong><\/p>\n<ul>\n<li>10 y\u0131ldan az olmamak \u00fczere hapis cezas\u0131<\/li>\n<li>20 bin g\u00fcne kadar adli para cezas\u0131<\/li>\n<\/ul>\n<p>Uyu\u015fturucu ticareti su\u00e7unun ilk kez i\u015flenmesi durumunda dahi hapis cezas\u0131 s\u00f6z konusu olabilir ve kamu davas\u0131n\u0131n ertelenmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<h2><strong>2. \u0130lk Uyu\u015fturucu Dosyas\u0131nda Hukuki S\u00fcre\u00e7 Nas\u0131l \u0130\u015fler?<\/strong><\/h2>\n<p>\u0130lk kez uyu\u015fturucu su\u00e7una kar\u0131\u015fan ki\u015filer i\u00e7in s\u00fcre\u00e7 genellikle \u015fu \u015fekilde ilerler:<\/p>\n<ol>\n<li><strong>Yakalanma ve G\u00f6zalt\u0131:<\/strong>\n<ul>\n<li>Ki\u015fi, uyu\u015fturucu madde ile yakalan\u0131rsa g\u00f6zalt\u0131na al\u0131nabilir.<\/li>\n<li>\u0130lk kez A\u00e7\u0131lmas\u0131n\u0131n Ertelenmesi (KDE) Karar\u0131:<\/strong>\n<ul>\n<li>E\u011fer ki\u015fi <strong>sadece kullanmak i\u00e7in uyu\u015fturucu bulundurmu\u015fsa<\/strong> ve daha kapan\u0131r<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h2><strong>3. \u0130lk Kez Uyu\u015fturucu Ticareti Su\u00e7undan Yakalananlar \u0130\u00e7in S\u00fcre\u00e7 Nas\u0131l \u0130\u015fler?<\/strong><\/h2>\n<p>Uyu\u015fturucu ticareti su\u00e7u daha a\u011f\u0131r cezalar i\u00e7erdi\u011fi i\u00e7in bu durumdaki ki\u015filer i\u00e7in s\u00fcre\u00e7 farkl\u0131 i\u015fler:<\/p>\n<ul>\n<li>Ki\u015finin uyu\u015fturucu sat\u0131\u015f\u0131 yapt\u0131\u011f\u0131na dair <strong>deliller (tan\u0131k beyan\u0131, kamera kayd\u0131, yakalanan madde miktar\u0131 vb.)<\/strong> varsa tutuklanma ihtimali y\u00fcksektir.<\/li>\n<li>Mahkemeye sevk edilen ki\u015finin tutuksuz yarg\u0131lanmas\u0131 i\u00e7in g\u00fc\u00e7l\u00fc delillere sahip olmas\u0131 gerekir.<\/li>\n<li>\u0130lk kez bu su\u00e7u i\u015fleyenler i\u00e7in de <strong>hapis cezas\u0131 zorunlu olabilir<\/strong>, ancak baz\u0131 hafifletici sebepler g\u00f6z \u00f6n\u00fcnde bilin\u00e7li hareket edilmelidir.<\/strong><\/li>\n<li><strong>\u0130fade verirken dikkatli olunmal\u0131 ve hukuki destek al\u0131nmal\u0131d\u0131r.<\/strong><\/li>\n<li><strong>Savc\u0131l\u0131\u011f\u0131n sundu\u011fu denetimli serbestlik karar\u0131na uyulmal\u0131d\u0131r.<\/strong><\/li>\n<li><strong>Tedavi s\u00fcreci ihmal edilmemelidir.<\/strong><\/li>\n<\/ul>\n<p>E\u011fer uyu\u015fturucu madde kullan\u0131m\u0131 nedeniyle bir soru\u015fturma ge\u00e7iriyorsan\u0131z, s\u00fcrecin hukuki boyutlar\u0131n\u0131 anlamak ve en do\u011fru \u015fekilde ilerlemek i\u00e7in <strong>deneyimli bir avukata dan\u0131\u015fman\u0131z<\/strong> b\u00fcy\u00fck \u00f6nem ta\u015f\u0131r.<\/p>\n<h3><\/h3>\n<p>\u0130lk defa uyu\u015fturucu dosyas\u0131 a\u00e7\u0131lan ki\u015filer i\u00e7in s\u00fcre\u00e7, su\u00e7un niteli\u011fine g\u00f6re de\u011fi\u015fiklik g\u00f6sterir.
