Punishment for the Crime of Theft<\/p>\n<p>The crime of theft is regulated in Articles 141-147 of the Turkish Penal Code (TCK). While simple theft is generally punished with a prison sentence of 1 to 3 years, the sentence may increase for qualified theft.<\/p>\n<p>If a prison sentence of 4 years and 2 months is given by the court, the execution calculation of this sentence is made as follows:<\/p>\n<p>2. Prison Periods for Theft<\/p>\n<p>A 1\/2 ratio execution system is applied when executing a prison sentence in Turkey. This means that half of the sentence is served. However, convicts who meet certain conditions in prison can be released earlier with parole.<\/p>\n<p>Half of a 4 year 2 month prison sentence: 2 years and 1 month in prison.<br \/>\nProbation: Can be applied with 1 year remaining.<\/p>\n<p>In this case, if your sentence is 4 years and 2 months, you will actually serve approximately 1 year and 1 month in prison and you can spend the remaining 1 year outside by benefiting from probation.<\/p>\n<p>3. Benefiting from Probation<\/p>\n<p>Probation is a system introduced for the purpose of reintegrating the convict into society after spending a certain period in prison. According to the execution regulation that came into force on March 30, 2020, those convicted of criminal offenses such as theft can complete the remaining part of their sentence with probation after spending a certain part of their sentence in prison.<\/p>\n<p>4. In Which Cases Can the Sentence Be Increased?<\/p>\n<p>In some cases, the duration of the sentence may be increased:<\/p>\n<p>Recidivist Crime: If you have previously been sentenced to prison for a similar crime, the execution rate may change.<br \/>\nDisciplinary Penalties: If prison rules are not followed, the right to parole or probation may be lost.<\/p>\n<p>Aggravated Crime: If the theft was committed with a weapon, at night, or in a place belonging to a public institution, the penalty rates may vary.<\/p>\n<p>5.<\/p>\n<p>When you are sentenced to 4 years and 2 months for theft, you can benefit from probation for up to 1 year after spending approximately 1 year and 1 month in prison.
