Although the judge is not bound by the witness statements, the witness statements are an important piece of evidence for the parties to prove their claims. Especially in divorce cases, since it is very difficult to prove the events between the spouses with evidence other than witnesses, it is seen that the evidence of witnesses is mostly relied on and the parties prove the facts they claim with the statements of witnesses.

Who Can Witness?

In divorce cases, anyone who witnesses the events claimed by the parties (such as friends, mother, father, sibling, aunt, uncle, neighbor) can be a witness. However, it has been regulated in the Code of Civil Procedure that some persons listed may refrain from testifying. These:

fiancee of either party

Even if the marriage bond is dissolved, the spouse of one of the two parties

Himself or his spouse’s descendants or descendants (such as mother, father, grandparent)

Those who have a foster bond with one of the parties

In-law relatives (such as sister, aunt, aunt, uncle) even if the marriage bond, including the third degree, has disappeared

The child taken under protection with the foster family and their children.

These persons have the right not to testify by declaring that they are hesitant to testify as required by law, if they do not want to.

Is Witness Obligatory?

Witnessing is accepted as one of the duties and responsibilities of the person towards the society. For this reason, persons other than those who have the right to abstain from testifying as listed above must testify. In the Code of Civil Procedure, it is regulated that everyone called to testify has to come, that witnesses who do not come without a valid reason will be brought by force and that a disciplinary fine of up to 500 TL can be imposed on these people:

“Reserving the provisions of the law, everyone summoned to testify has to come. A witness who is duly summoned but does not come without giving an excuse is brought by force, the expenses caused by his absence, and a disciplinary fine of up to five hundred Turkish Liras. The witness brought by force will justify his failure to show up earlier. If he reports the reasons later, the expenses and disciplinary fines imposed against him will be lifted.”

Is It Mandatory For The Witness To Go To Court?

As a rule, witnesses testify orally before the Court. He gives his testimony before the judge and the parties, and answers the questions asked by the judge or the parties.

However, in some cases, since it is difficult for the witness to go to the court that hears the case, it is decided to be heard through “letter of rogatory”. E.g; If the witness resides in Istanbul but the case is pending in Ankara, the Istanbul Courts are requested to hear the witness by rogatory letter. Thus, the witness testifies before the judge in the court in Istanbul.

How Many Times Is The Witness List Given?

In the pending case, which claims will be proved with which witness statement, the court is notified with the witness list. This list includes the names and surnames, TR Identity Numbers and full addresses of the witnesses.

However, a witness list can only be submitted once within the scope of a case file and it is not possible to submit a second list. For this reason, it is not possible as a rule to listen to people who are not included in the list of witnesses presented as witnesses. Likewise, if the witness list is not submitted in due time, the Court will not listen to witnesses. However, an exception to this rule is regulated in Article 243 of the Code of Civil Procedure:

“The witness is summoned by invitation. However, the witness who is present by the parties before the invitation is sent is also heard. In the case where a definite time is given for the witness list and the rest day is determined, even if the list is not given, if the party presents them at the hearing, the witnesses are heard.”

In accordance with the aforementioned article, the witness who is present at the hearing is heard regardless of whether a list is given or not. For this;

A definite deadline has been given for the submission of the witness list; and

The date of the hearing of the witnesses should be known by the parties.

TO CONTACT NOW: 0 541 485 92 48

TO CONTACT NOW: 0 541 485 92 48 EFFECT OF WITNESSES ON DIVORCE A witness is a person who verbally declares before the Court the information he heard, saw and acquired in this way.
