Divorce Due to Deception (Adultery)<\/h2>\n

This type of lawsuit, which is processed by the family court in accordance with Article 161 of the Civil Code, arises as a result of cheating (adultery) of one of the couples on their spouse.<\/p>\n

Within the framework of this law, individuals are accepted as a lawsuit only if there is a situation of deception (adultery). This is when one of the spouses kisses, hugs or touches another person, etc. In case of such situations, it is not accepted as adultery by the Civil Code. In the event of such a situation, individuals must file a divorce lawsuit on the grounds of leading a dishonorable life (MK art. 163) while applying to the court.<\/p>\n

Divorce Case Court Process<\/h3>\n

In case the court proves the existence of deception (adultery) by supporting with evidence, it can carry out the proceedings and give a divorce decision based on the specific reason for divorce. A person who learns that his wife has cheated on him (adultery) can file a divorce case within 6 months, pursuant to Article 162\/2 of the Civil Code, after obtaining this information.<\/p>\n

When Can Divorce Due to Adultery Be Filed?<\/h4>\n

However, the party who learns that he has been deceived (adultery) can also request a divorce if he learns that this act is not new. At this stage, it will be sufficient that the 5-year statute of limitations has not expired. Let’s say that the person cheated on his wife on 01.01.2014 and his wife learned about it on 30.12.2019, even if there is 1 day left before the expiration of the 5-year period, he can file a divorce case due to cheating (adultery).<\/p>\n

However, despite the expiry of the 5-year statute of limitations, this act of deception (adultery) committed during the general divorce lawsuit filed afterward can be accepted as a justification for divorce.<\/p>\n
