Crime of Human Trafficking in the Turkish Penal Code<\/p>\n
In Article 80 of the Turkish Penal Code (TCK), the crime of human trafficking is defined as follows:<\/p>\n
(1) A person,<\/p>\n
a) Forced labor or service, b) Forced into prostitution, or c) Subjected to slavery or similar practices, d) For the purpose of ensuring the donation of body organs;
\nUsing threats, pressure, force or violence,
\nAbuse of influence,
\ndeceive or
\nAnyone who supplies, transports, dispatches, shelters or receives people by taking advantage of their control over them or their helplessness to obtain their consent is sentenced to imprisonment from eight to twelve years and a judicial fine of up to ten thousand days.<\/p>\n
Elements of Crime<\/p>\n
For a crime to occur, the following elements must be present:<\/p>\n
Victim: The victim of the crime can be anyone. However, disadvantaged groups such as children under 18, disabled people, immigrants and refugees are at greater risk.
\nAct: The act of the crime is to subject the victim to forced labor, service, prostitution, slavery or similar practices, or to have her body organs donated.
\nIntent: The perpetrator must act with the intention to exploit the victim.
\nMeans: The perpetrator may use a variety of means, such as deceiving the victim, threatening him, using violence, or unlawfully obtaining his consent.<\/p>\n
Punishment<\/p>\n
The penalty for the crime of human trafficking is imprisonment from eight to twelve years and a judicial fine of up to ten thousand days. If the perpetrator is a public official, the penalty is increased.","protected":false},"excerpt":{"rendered":"
