Definition of the Crime of Extortion<\/p>\n
The crime of extortion, regulated in Article 250 of the Turkish Penal Code, is defined as a public official providing a benefit to himself or someone else in exchange for taking or not taking an action related to his duty. This benefit may be money, goods, gifts, services or any material or moral gain.<\/p>\n
Elements of the Crime of Extortion<\/p>\n
Perpetrator: The perpetrator of the crime is a public official. In this context, civil servants, judges, prosecutors, soldiers and other public officials may be held responsible for the crime of extortion.
\nAct:\u00a0The act of the crime is to obtain benefit in exchange for doing or not taking an action related to one’s duty. This process can take many different forms, such as granting licenses, rigging tenders, and accruing taxes.
\nIllegality: In order for a crime to occur, the perpetrator’s action must be unlawful. Therefore, the duty must be fulfilled within the framework of the law and no benefits should be claimed.
\nVictim: The victim of the crime is the person or public authority from whom the benefit is sought.<\/p>\n

The punishment for the crime of extortion varies depending on the way and amount of benefit the perpetrator obtains.<\/p>\n
Extortion by force: Imprisonment from 5 to 10 years
\nExtortion by persuasion: Imprisonment from 3 to 5 years
\nExtortion by taking advantage of the victim’s mistake: Imprisonment from 1 to 3 years<\/p>\n

The crime of embezzlement is not subject to complaint. For this reason, an investigation can be initiated by the authorities who are aware that the crime has been committed, without waiting for the victim to file a complaint.<\/p>\n
