However, in these relationships, sometimes situations arise where the rights of creditors must be protected. At this point, the crime of causing damage to the creditor comes into play.<br \/>\nThe crime of causing damage to a creditor is regulated in Article 187 of the Turkish Code of Obligations (TBK). According to this article, if the debtor decreases the assets with the intention of causing loss to his creditor, he is punished with imprisonment and judicial fine.<br \/>\nElements of the Crime:<br \/>\n\u2022 Perpetrator: Debtor<br \/>\n\u2022 Victim: Creditor<br \/>\n\u2022 Verb: Decreasing assets with the intention of causing loss to the creditor.<br \/>\n\u2022 Moral Element: Intention<br \/>\nCurrent Decrease:<br \/>\nCurrent reduction means that the debtor reduces his assets so that the creditor cannot collect his receivable. This can be done in various ways:<br \/>\n\u2022 Selling or transferring assets: The debtor may sell or transfer his assets to a third party in order to cause a loss to his creditor.<br \/>\n\u2022 Indebtedness to a creditor: The debtor may owe money to other people instead of paying his debt to the creditor.<br \/>\n\u2022 Hiding assets to avoid seizure: The debtor may hide his assets to prevent his creditor from collecting his debt.<br \/>\nPunishment for Crime:<br \/>\nThe penalty for the crime of causing loss to a creditor is imprisonment from six months to three years and a judicial fine of up to one thousand days. The court determines the punishment according to the nature of the concrete incident and the severity of the crime.<br \/>\nComplaint:<br \/>\nThe crime of causing damage to a creditor is a crime subject to complaint. Therefore, the creditor must file a complaint within three months of learning that the crime has been committed.
