However, for workplace lease agreements whose tenant is a merchant or legal entity, the effective date of these new provisions has been postponed to 1 July 2020.<br \/>\nThis postponement period has also been extended by Law No. 6353, and unless the postponement foreseen in Law No. 6217 is extended by a new legal regulation, Article 9 of the TBK, which will be explained below, will also apply to workplace lease agreements whose tenants are merchants or legal entities as of July 1, 2020. will find the area.<br \/>\nScope of New Provisions<br \/>\nThe new provisions in force for workplace lease agreements since July 1, 2020 are:<br \/>\n\u2022 Determination of the Rental Price: According to Article 343 of the Turkish Code of Obligations, no changes can be made to the detriment of the tenant in rental agreements other than determining the rental fee. This means that the rental price will remain constant for the duration of the contract. However, it is possible to deviate from this provision if the way the rental fee is determined is clearly stated in the contract and if this method of determination does not cause harm to the tenant.<br \/>\n\u2022 Adjustment of the Rental Fee: According to Article 344 of the Turkish Code of Obligations, the rental fee can be increased every year by the Consumer Price Indices (CPI), unless there is a provision to the contrary in the contract. The rental fee is determined in January every year according to the CPI, and the new rental fee begins to be applied at the beginning of the first rental period of the next year of the rental agreement.<br \/>\n\u2022 Sublease: According to Article 345 of the Turkish Code of Obligations, the tenant may rent (make a sublease agreement) the leased property to a third party (sublessee) to fulfill his\/her rent and other obligations.
