This person may be the drawer (issuer) of the check or the holder (person holding the check).<br \/>\n\u2022 Victim of the Crime: The person who cannot collect the check. This person is the person or holder to whom the check is written (to the recipient).<br \/>\n\u2022 Subject of the Crime: The dishonored check. There must be insufficient money in the check account on the date the check is presented and the check must be presented as &#8220;unfunded&#8221;.<br \/>\n\u2022 Intent of the Crime: A special intention is not required to commit the crime. In other words, it is not necessary for the perpetrator to issue a bad check knowingly or willingly. Honorary negligence is sufficient.<br \/>\nPunishment for the Crime of Issuing a Bad Check<br \/>\n\u2022 Judicial Fine: A judicial fine of up to one thousand five hundred days is imposed for each check for the crime of issuing a bad check. The amount of the judicial fine cannot be less than the amount of the unpaid check.<br \/>\n\u2022 Restrictive Imprisonment: If the judicial fine is not paid, a repressive prison sentence may be imposed on the perpetrator. The duration of the prison sentence is determined according to the daily amount of the unpaid judicial fine.<br \/>\n\u2022 Prohibition on Issuing Checks and Opening a Check Account: The court may also impose a ban on the perpetrator from issuing checks and opening a checking account.
