Blackmail is the threat of revealing or imputing matters that will harm the honor and reputation of the victim, in order to force a person to do or not do something that is illegal or for which he is not obliged, or to gain unfair advantage. Threat: Threatening that matters that will harm the honor and reputation of the victim will be disclosed or attributed.
\nCoercion: The intention to force the victim to do or not do something that is against the law or for which he is not obliged, or to obtain unfair advantage.
\nLink: There is a connection between the threat and the desired action.<\/p>\n
Punishment for Blackmail Crime:<\/p>\n
The punishment for the crime of blackmail is regulated in Article 107 of the Turkish Penal Code. According to this:<\/p>\n
Basic Form: It is punishable by imprisonment from one to three years and a judicial fine of up to five thousand days.
\nQualified Complaint: If blackmail is committed against a public official, the penalty increases from one to five years of imprisonment and a fine from seven billion to twenty billion liras.
\nFulfillment of the Threat: If the blackmail perpetrator fulfills his threat, he will be sentenced to imprisonment from two to seven years and a heavy fine from twenty billion to forty billion liras.<\/p>\n
Ways to Protect Against Blackmail Crime:<\/p>\n
Not Bowing to the Threat: Giving in to the blackmailer’s threat is the wrong way to solve the problem. This may cause the blackmailer to become even more courageous and increase his demands.
\nCollecting Evidence: It is important to collect messages, emails, voice recordings or other evidence containing the blackmailer’s threats. This evidence can be used when filing a criminal complaint and as evidence in court.
\nFiling a Criminal Report: The blackmail victim must file a criminal complaint with the nearest Public Prosecutor’s Office or law enforcement officers.
