In this article, we will examine the connection between these two areas and how the penal system ensures that it operates in accordance with human rights.<\/p>\n<p>What are Human Rights?<\/p>\n<p>Human Rights are the name given to the universal and innate fundamental rights and freedoms that belong to all people. These rights belong to all people, regardless of race, gender, religion, language, nationality or any other status, and are under the protection of the state.<\/p>\n<p>What is Criminal Law?<\/p>\n<p>Criminal Law, on the other hand, is the law that defines and punishes crimes. It aims to impose sanctions on those who commit crimes and maintain order in society.<\/p>\n<p>The Connection Between Human Rights and Criminal Law<\/p>\n<p>Criminal Law is used to protect human rights. It grants criminals the right to a fair trial and punishment. It also contributes to increasing respect for human rights in society by providing deterrence against crimes that violate human rights.<\/p>\n<p>However, there is also a risk that criminal law may violate human rights. For example, unfair trials, disproportionate sentences and arbitrary detentions can lead to human rights violations.<\/p>\n<p>The Penal System Should Operate in Accordance with Human Rights<\/p>\n<p>For the penal system to operate in accordance with human rights, it is important to ensure that:<\/p>\n<p>Right to a Fair Trial: Offenders must be given the right to a fair and impartial trial.
