The financial rights and obligations of spouses in a divorce case are of critical importance for the fair arrangement of the financial situation of both parties. In this article, we will discuss in detail the financial rights and obligations of spouses in the divorce process and the points to be taken into consideration in this regard.

Property Sharing and Distribution

1.1. Assets Accumulated During Marriage

The sharing of assets accumulated during marriage is one of the most important issues in a divorce case. In Turkey, property sharing is generally regulated as follows:

Participation in Acquired Assets Regime: In this regime, assets acquired during marriage are shared equally. However, personal assets (such as pre-marital assets, inheritances or donations) remain outside this scope.
Property Separation Regime: In this regime, each spouse has full rights to their own assets and assets acquired during the marriage are not shared.

Sharing: Assets acquired during the marriage must be shared equally during the divorce. A property sharing table can be prepared to determine the assets of the spouses.

1.2. Property Rights

Immovable Properties: The sharing of immovable properties such as houses, land, and workplaces is done according to property rights. Immovable properties are usually transferred through a notary or offered for sale.
Movable Properties: The sharing of vehicles, furniture, and other movable properties is done by taking into account the value of the properties.
Alimony Request

2.1. Alimony in Poverty

Alimony in poverty is a type of support given to a spouse who is experiencing economic difficulties after divorce. The alimony request must meet the following conditions:

Request: It can be requested during or after the divorce case.
Conditions: Factors such as the spouse’s financial situation, post-divorce needs, and the requesting spouse’s economic situation are taken into consideration.

2.2. Participation Alimony

It is the alimony paid to meet the education, health and other needs of children. This type of alimony, determined to cover the child’s care and education expenses, has an important place in the divorce process.

Material Compensation

3.1. Compensation Request

In divorce cases, one of the spouses may request material compensation. Compensation is paid to cover the economic damages caused by the divorce. The following should be taken into consideration when requesting compensation:

Determination of Damages: The spouse who will request material compensation must concretely present the economic damages of the divorce.
Requirements for Request: The factors determining the spouse’s economic situation, the damages caused by the divorce and the amount of compensation are taken into consideration.

3.2. Non-pecuniary Compensation

Pecuniary compensation may be requested in cases where the divorce process affects the psychological and emotional state of the parties. Non-pecuniary compensation does not cover material damages, but aims to compensate for the personal effects of the divorce.

Distribution of Debts

4.1. Joint Debts

During the divorce process, it is important how the couple’s joint debts will be shared. Joint debts include loans, credit card debts or other financial obligations taken out during the marriage:

Sharing: Joint debts are shared fairly between both spouses. Payment of debts is considered together with property division.

Payment Plan: Making a payment plan on how debts will be paid can ease the financial burden for both parties.

4.2. Personal Debts

Debts taken out before marriage or personally are generally not charged to the other spouse. However, the court may decide on the sharing of these debts.

Marriage Contracts and Preventive Arrangements

5.1. Marriage Contracts

Marriage contracts can clarify the rights and obligations of the parties during the divorce process. A contract made as a preparation before the marriage determines how the assets, alimony and debts will be shared.

5.2. Legal Consultation

Receiving professional legal consultancy regarding financial rights and obligations during the divorce process ensures a fair and lawful sharing throughout the process.

In a divorce case, the financial rights and responsibilities of the spouses are important issues that increase the complexity of the process. Property division, alimony claims, material and moral compensation, debt sharing and marriage contracts are the most critical elements of this process. It is important to get legal advice so that both parties can protect their rights and find a fair solution.

Financial Rights and Obligations of Spouses in Divorce Cases The divorce process is a period when couples experience major changes not only emotionally but also financially.
