Each stage of this process must be followed meticulously. There are four basic stages of criminal procedure and each stage includes different legal procedures. These stages and the tips to be considered in these stages are explained in detail below.

1. Investigation Stage
Initiation of Investigation: The investigation stage begins with the receipt of information that a crime has been committed. As a result of a crime report or complaint, law enforcement officers or the public prosecutor begin to investigate the incident. The purpose of the investigation stage is to determine whether a crime has been committed and who the suspect is. Example: When a person is alleged to have committed theft, the police begin to investigate this claim and collect evidence. If there is sufficient suspicion, the prosecutor steps in.

Gathering Evidence: At this stage, evidence regarding the incident is collected, witnesses are heard and the suspect’s statement is taken. It is very important to collect evidence in accordance with the law. Evidence obtained through illegal means is not considered valid in the trial. For example: If a suspect’s cell phone is wiretapped without permission, this evidence may be deemed invalid in court.

Detention and Arrest: Depending on the severity of the crime and the status of the evidence, the suspect may be detained. If an arrest warrant is issued for the suspect, he/she may remain in custody throughout the investigation. Hint: Arrest can only be applied in cases of “strong suspicion of a crime” and “risk of escape or obscuring evidence.” The arrest warrant may be appealed.

2. Prosecution Phase
Preparation of the Indictment: If the prosecutor finds sufficient evidence at the end of the investigation, he/she prepares an indictment and submits it to the court. The indictment is a document that explains what the accusation is and what evidence it is based on. For example: In a fraud case, the prosecutor may prepare an indictment that includes evidence proving that the suspect used other people’s bank information without permission.

Filing of the Case: The prosecution phase begins with the acceptance of the indictment by the court. The suspect now becomes the defendant and is subject to trial. Hint: Whether or not the indictment will be accepted is decided by the court’s initial evaluation. If there are deficiencies or legal issues in the indictment, the court may return the indictment.

3. Trial Phase
Holding of Hearings: The trial phase is the phase where the defendant is brought before the court, evidence is presented and witnesses are heard. The defendant has the right to present his defense. Example: A driver who is alleged to have caused injury through negligence after a traffic accident has the right to explain how the accident occurred at the hearing.
Examination of Evidence: The evidence presented by the prosecutor’s office and the defendant is evaluated throughout the trial. The judge reaches a decision by considering the evidence and the statements of the parties. Hint: While evidence is presented against the defendant, his lawyer should also present evidence that may be in favor of the defendant and present his defense. The fact that the evidence is legal increases the strength of the defense.
Right to Defense: The defendant has the right to defend himself. During this process, he/she can present evidence to the court through his/her lawyer, question witnesses and express his/her own claims. Hint: The right to defense is one of the most fundamental elements of criminal proceedings. The defendant must determine a strong defense strategy together with his/her lawyer.

4. Verdict and Execution Phase
Court Decision: At the end of the hearings, the judge reaches a decision based on the evidence and statements. With this decision, the defendant is either acquitted or convicted. The sentence is specified together with the conviction decision. Example: In a theft case, if the defendant is found to have committed the crime, he/she may be sentenced to imprisonment. However, the execution of the sentence may be postponed in some cases.

Right to Appeal: If the convicted person does not accept the decision, he/she can appeal or appeal. This application allows the decision to be reviewed by a higher court. Hint: During the appeal process, it is examined whether the previous court evaluated the evidence correctly. At this stage, it is very important to present a strong legal justification.
Execution of the Sentence: The sentence is executed when the court decision becomes final. If the defendant has been sentenced to imprisonment, he/she begins serving his/her sentence. In addition, fines or other sanctions may be imposed. Example: A person convicted in a forgery case begins serving his/her prison sentence or pays a fine.

What are the Stages of Criminal Procedure?
