1. Non-Existence of Alimony Conditions
If the spouse’s financial situation is good: Alimony is given to the spouse who is experiencing financial difficulties. If the other spouse’s financial situation is sufficient and he/she can provide for himself/herself, the alimony request may be rejected.
Equal fault or total fault: If the spouse requesting alimony is equally at fault or more severely at fault in the divorce, alimony will not be awarded.
For example, a spouse found to be at fault due to reasons such as adultery, abandonment or violence cannot claim alimony.
2. In the Case of Child Support (Participation Alimony)
Granting custody to the father: If the custody of the children is granted to the father, the father’s obligation to pay child support is eliminated.
Failure to meet the child’s economic needs: If the child’s economic needs are already met or there is no special situation requiring alimony, alimony will not be paid.
3. Termination of Alimony
Remarriage of the spouse: If the spouse receiving alimony remarries, the alimony payment ends.
A relationship similar to a de facto marriage: If the spouse receiving alimony lives a life similar to a de facto marriage, the alimony is also terminated.
Improvement of financial situation: If the economic situation of the spouse receiving alimony improves, for example, if he/she starts earning a good income, this may lead to the alimony being lifted.
Death of the spouse receiving alimony: If the spouse receiving alimony dies, the alimony payment obligation ends.
4. In consensual divorces
If the parties agree not to request alimony within the scope of the divorce protocol, the man does not pay alimony. If the court approves this protocol, the alimony obligation is eliminated.
5. Cancellation or Removal of Alimony
Unjustified alimony request: If it is proven that the alimony request is bad-intentioned or based on an unjust reason, alimony will not be awarded or may be canceled.
Financial difficulties: If the financial situation of the man paying alimony worsens, he can apply to the court and request that the alimony be reduced or removed.
