Rights of the Author, Protection and Transfer of Rights
Within the scope of the Law on Intellectual and Artistic Works (FSEK), the owner of the work is granted a number of rights that enable him to benefit from the material and moral values ​​​​created by his work. This article will include information about the rights of the author, the protection and transfer of these rights.
Rights of the Author
The author is the original creator of his work and has financial and moral rights arising from this work. These rights are divided into two:
Financial Rights:
• Right to publish: It is the right to reproduce the work and present it to the public for the first time.
• Reproduction right: It is the right to create a material copy of the work.
• Right to include: It is the right to include the work in another work.
• Right to adapt: ​​It is the right to transform the work into a different work.
• Right of display: It is the right to present the work publicly.
• Right to disseminate: The right to sell or distribute copies of the work.
Moral Rights:
• Naming right: It is the right to associate the work with the name or pseudonym of the author.
• Right to integrity: It is the right not to alter the work in accordance with its original.
• Right to recognition: It is the right of the author to be recognized as the creator of the work.
Protection of Rights
The rights of the author are protected within the scope of FSEK and other relevant legislation. If the author has violated the law in cases such as unauthorized reproduction, dissemination, adaptation or representation of his work, he may file a lawsuit for material and moral damages. He may also request injunctive relief to prevent unlawful use of the work.
Transfer of Rights
The owner of the work can transfer his financial rights to someone else with a written contract. In the transfer process, the work must be completed and the transferor and the transferee must agree. Transfer of financial rights may be partial or full. The transferee has the authority to use the transferred rights and benefit from the fruits of these rights.
The moral rights of the author cannot be transferred. The author always has the right to protect the integrity of his work and to ensure that his name is associated with his work.
