What is the Crime of Insult?
Insult is a crime committed by publicly insulting a person’s honor and dignity, as defined in the Turkish Penal Code. In other words, actions taken to humiliate, degrade or damage a person’s honor in public fall within the scope of the crime of insult.
Elements of the Crime of Insult

In order for the crime of insult to occur, the following elements must come together:
• Perpetrator: The person who commits the crime.
• Victim: The person whose honor and dignity is damaged.
• Insult statement: A verbal or written statement that damages the honor and dignity of the victim.
• Publicity: The insult statement is made in a way that can be heard or seen by more than one person.
Types of the Crime of Insult
Insult is divided into different types according to the way it is committed:
• Simple insult: Insults made directly against a person.
• Qualified insult: A type of insult that has a more severe penalty if the insult crime has certain special characteristics (for example, it is committed against a public official, it is spread through the press).

In the crime of insult, the suspect or the defendant can use various defense methods. Some of these defense methods are as follows:
• Justified criticism: The claim that the criticism made is not an insult but a justified criticism.

• Dissemination of a news story that is claimed to be true: The claim that no crime was committed, only true news was spread.

• Legitimate defense: The claim that it was an action taken to protect oneself or someone else.
