Is There Effective Remorse in Theft?

In our legal system, there is an institution called effective remorse, which provides a reduction in the penalty or exemption from punishment if the person who committed the crime feels remorse and eliminates or mitigates the consequences of the crime. However, this regulation does not apply to every type of crime. So, can effective remorse provisions be applied to the crime of theft? Here are the details:

1. What is the Crime of Theft?

According to Article 141 of the Turkish Penal Code (TCK), the taking of a movable property belonging to another person without their consent constitutes the crime of theft. This crime can be committed in different ways and the amount of the penalty may vary depending on the nature of the crime.

Effective remorse is a criminal law mechanism that provides a reduction in the penalty or impunity if the person who committed the crime compensates for the damages caused by the crime and sincerely regrets it. Effective remorse provisions are regulated for different types of crimes in various articles of the TCK.

3. Effective Repentance in the Crime of Theft

Article 168 of the Turkish Penal Code regulates the provisions of effective repentance in the crime of theft. Accordingly, if the following conditions are met, the penalty may be reduced or, in some cases, the penalty may be completely eliminated:

If the stolen property is returned in its original condition or its damage is compensated before the investigation begins, the penalty may be reduced by up to two-thirds.

If the stolen property is returned in its original condition or its damage is compensated before the prosecution begins, the penalty may be reduced by up to half.

If the stolen property is returned in its original condition or its damage is compensated before the verdict is given, the penalty may be reduced by one-third.

However, the application of effective repentance provisions is more limited in the crimes of theft committed within the criminal organization and qualified theft crimes.
