In criminal law, the sanctions to be applied against crimes committed by individuals are determined by law. However, in some cases, courts may give lighter sentences to defendants. Whether there is a sentence reduction, especially for those who commit a crime for the first time, is among the issues that many people are curious about. So, is there a “first offense sentence reduction”? If so, under what conditions is it applied? Here are the details…

1. Is It Possible to Reduce a Sentence for a First Offense?

Within the scope of the Turkish Penal Code (TCK), there is no general regulation directly under the name of “first offense sentence reduction” for those who commit a crime for the first time. However, courts may reduce the sentence by taking into consideration factors such as the defendant’s past, the criminal process and the possibility of committing a crime in the future.

2. Factors that Mitigate the Sentence

For those who commit a crime for the first time, courts may apply a sentence reduction within the framework of the following legal regulations:

a) Suspension of the Announcement of the Sentence (HAGB)

Suspension of the announcement of the sentence can be applied to defendants sentenced to 2 years or less in prison. A person who commits a crime for the first time may request a postponement of his/her sentence and if he/she does not commit another crime within the determined probation period, the sentence will not be executed.

b) Reasons for Discretionary Reduction (TCK Article 62)

Courts may apply discretionary reduction in the sentence by evaluating factors such as the defendant’s attitude at the hearing, his/her remorse and the manner in which the crime was committed.

c) Effective Repentance Provisions

In some types of crimes (such as fraud, theft, drug use), the defendant may receive a sentence reduction if he/she compensates for the damages after committing the crime or contributes to the solution of the crime by providing information to the authorities.

d) Suspension of Sentence

In some cases, the court may postpone the prison sentence given to the defendant. In particular, a decision may be made not to execute the sentence for individuals who have no previous criminal record and whose crimes are of low severity, provided that they do not commit a crime during a certain probation period.

3. In Which Crimes Can Sentence Reduction Be Applied for a First Offense?

Not every crime is subject to a sentence reduction if it is committed for the first time. For example, the probability of a sentence reduction is lower for serious crimes or crimes that threaten public safety (such as murder, sexual assault). However, for less serious crimes (such as simple assault, theft, fraud), the court may take into account the defendant’s lack of a criminal record.

4.

Although there is no general rule in the Turkish legal system under the name of “sentence reduction for a first offense”, courts may apply a reduction by evaluating factors such as the defendant’s clean criminal history, the way the crime was committed, and their remorse. Provisions such as postponement of the announcement of the verdict, discretionary reasons for reduction, effective remorse, and suspension of the sentence may provide advantages for first-time offenders.
