Structures constructed in violation of zoning legislation are called “illegal structures” or “structures in violation of zoning legislation”. The relevant administrations may decide to demolish such structures. Demolition decisions are made based on the Zoning Law No. 3194 and related regulations. The legal process regarding the demolition of structures in violation of zoning legislation is as follows:

### 1. *Inspection and Detection:*
Structures in violation of zoning legislation are detected during inspections conducted by the municipality or governorship. This determination can be made upon complaint or ex officio.

### 2. *Construction Holiday Memorandum:*
When it is determined that the structure is in violation of zoning legislation, a construction holiday memorandum is issued and the structure is sealed. Construction activities of the structure are stopped with this memorandum.

### 3. *Giving a Correction Period:*
The relevant parties are given a period to bring the sealed structure into compliance with zoning legislation. This period is usually 30 days. If the building owner does not bring the building into compliance with the legislation within this period, the demolition process will be initiated.

### 4. *Demolition Decision:*
If the building is not brought into compliance with the legislation within the given period, a demolition decision will be made by the municipality or governor’s office. This decision will be notified to the relevant building owner.

### 5. *Implementation of Demolition:*
After the demolition decision becomes final, the building owner can demolish the building himself by complying with this decision. If demolition is not carried out, demolition will be carried out by the administration. Demolition costs will be collected from the building owner.

### 6. *Court Recourse:*
After the demolition decision is notified, the building owner can file an annulment lawsuit against this decision in the administrative court. Filing a lawsuit does not automatically stop the demolition process, however, demolition can be stopped if the court issues a stay of execution.

### 7. *Claim Against Demolition Decision:*
In the event of a lawsuit being filed against the demolition decision, the decision of the court is important. If the court decides that the demolition decision is lawful, the demolition process is carried out. If the court cancels the demolition decision, the building will not be demolished and an opportunity may be given to bring it into compliance with the legislation.

In short, the demolition of a building that violates the zoning legislation is carried out within the framework of a specific legal procedure and the building owner has the right to appeal to the courts during this process.
