What is Job Security?
Job security means that the employer cannot terminate the employment contract except under certain conditions. These conditions are situations such as the worker engaging in immoral behavior, stealing at the workplace, or causing damage to the workplace.
Who Benefits from Job Security?
According to the Labor Law No. 4857, all workers working with an indefinite-term employment contract are covered by job security. Fixed-term employment contracts, on the other hand, terminate when a certain job is completed or a certain period of time expires.
What Rights Does Job Security Provide to Workers?
Protection Against Unfair Termination: The employer cannot terminate the employee’s employment contract without legal justification. In case of unfair termination, the employee has the right to demand reinstatement or compensation.
Notice Pay: When the employment contract is terminated by the employer or the employee leaves the job for a justified reason, notice pay is paid to the employee. Notice compensation is the amount of one month’s wage for each year the worker works at the workplace.
Severance Pay: The worker has the right to receive severance pay when he leaves the job after working for a certain period of time or when the employment contract is terminated by the employer. Severance pay is the amount of one month’s salary for each year the employee has worked at the workplace.
Right of Termination: The employee has the right to terminate the employment contract under certain conditions. These conditions include situations such as the employer’s unethical behavior in the workplace and situations that endanger the health or safety of the employee.
