What is Appeal? Legal Recourse of Appeal in Civil Cases
In civil cases, appeal is a legal process that allows a court’s decision to be reviewed and decided by a higher court upon the objection of one or both parties. Appeal has an important place in the Turkish legal system and ensures that the legality of the decision is observed.
Appeal Process
In a civil case, the appeal process follows the announcement of the decision. One or both parties may appeal against the court decision. The appealed decision is examined and evaluated by the court of appeal. The court of appeal may confirm the decision, partially modify it or completely overturn it. When a reversal decision is made, the case is sent back to the relevant court for retrial.
Court of Appeal
In the Turkish legal system, courts of appeal were established in accordance with the Law on Courts of Appeal. There are two different categories of appeal courts, appeal courts and regional courts of justice. Appellate courts are responsible for reviewing appealed decisions. Regional courts of justice review the decisions made by the appellate courts and make the final decision.
Process in Appeal Cases
The appeal process is a process that extends from the beginning to the conclusion of the civil case. There are certain steps that parties must follow carefully to protect their rights:
1. Announcement of the Decision: The first step is for the original court to announce its decision. Following the announcement of the decision, the parties have the right to object.
2. Objection Period: Parties have a certain period of time to object. This period usually starts from the notification of the decision.
3. Petition of Objection: The parties apply with a written petition to appeal to the court of appeal. The petition must state in detail the grounds for the contested decision and the reasons for the appeal request.
4. Appeal Review: The appeal court examines the file and evaluates the decision. The parties may usually have the opportunity to argue orally.
5. Decision: The court of appeal makes a decision after examining the file. The decision may confirm, partially modify or completely overturn a previous court decision.
