TBK m.350: The lessor, the lease agreement; 1. If there is an obligation to use the rented property for himself, his spouse, descendants, descendants or other persons whom he is obliged to look after due to the need for housing or workplace, 2. If it is necessary to repair, expand or change the leased property for the purpose of rebuilding or zoning, and it is impossible to use the leased property during these works, a period will be determined starting from the end of the term in fixed-term contracts, the termination period in accordance with the general provisions of the lease in indefinite-term contracts and the date to be determined in accordance with the periods stipulated for the termination notification. The owner and the lessor may file an eviction lawsuit due to need, citing the needs of himself, his spouse, descendants, descendants and dependents as per the law, in accordance with Article 350 of the TCO. The dependents of the lessor represent the descendants, descendants and siblings of the lessor. The lessor must have a claim of need, otherwise an eviction lawsuit cannot be filed based on a need that takes a long time to arise. If there is more than one tenant in the rental agreement, the hostility should be directed to all tenants. The lessor will be able to prove his claim with all kinds of evidence. The lawsuit must be filed within one month, starting from the date to be determined by the end of the term in fixed-term contracts, the termination period in accordance with the general provisions regarding the lease in indefinite-term contracts, and the deadlines stipulated for the notice of termination. Pursuant to TCO article 353, if the lessor notifies the lessee in writing during the filing period or during the litigation period, the lawsuit can be filed within a prolonged rental year following the notification. However, if there is a special regulation regarding the termination periods in the contract signed between the parties, notice should be given by paying attention to these periods.
