Deletion of Civil Servant Disciplinary Punishment from Record: A Comprehensive Guide
Deleting civil servant disciplinary penalties from the record is an important issue for public officials. In this article, I will share with you detailed information regarding the deletion of disciplinary penalties from the record within the framework of Article 133 of the Civil Servants Law No. 657.
Which Penalties Can Be Deleted?
Excluding the penalty of dismissal from civil service, warning and reprimand penalties can be deleted from the record 5 years after their implementation, and penalties of cutting salary and suspension of grade advancement can be deleted from the record 10 years after their implementation by applying to the superior authorized to appoint.
What are the Deletion Conditions?
• The disciplinary punishment must be final.
• The penalty must have been applied.
• The sentence must have expired.
• The officer must not have received a new disciplinary penalty during this period.
How to Apply?
The civil servant applies with a written petition to the superior authorized to appoint. In the petition, the disciplinary penalty and the reasons for which it is requested to be deleted from the record are stated. The chief authorized to appoint, after receiving the opinion of the disciplinary board, examines the petition and makes a decision.
Objection to Decision
The decision made by the chief authorized to appoint may be appealed to the Administrative Court within 10 days.
Matters to be taken into consideration
• Deletion of disciplinary punishment from the record is not an acquired right. The chief authorized to appoint makes a decision by taking into account the opinion of the disciplinary board and the officer’s service history.
• Deletion of disciplinary punishment from the record does not mean that the officer forgives his past mistakes. Even if the penalty is expunged from the record, disciplinary action may leave a mark on the officer’s record.
• Civil servants can review the relevant legislation or consult a lawyer for more detailed information regarding the deletion of disciplinary penalties from the record.
