Distance Sales and Contract
A distance contract, a distance selling contract, is a contract for the remote marketing of goods or services without the simultaneous physical presence of the seller or supplier and the consumer.
In distance contracts established by means of communication, the consumer should be informed clearly and clearly by the seller or provider. The burden of proof that the consumer has been informed is on the seller or provider. The seller or the provider must fulfill the consumer’s order within 30 days at the latest from the moment it reaches him. If the seller or the supplier does not fulfill his obligation within 30 days, the consumer may terminate the contract.
Is There a Right of Withdrawal in the Distance Sales Contract?
The consumer has the right to withdraw without giving any reason within fourteen days. If the consumer is not properly informed about the right of withdrawal, he is not bound by the fourteen-day period to use the right of withdrawal. However, in any case, this period is one year from the end of the withdrawal period. The consumer is not responsible for changes and deteriorations that occur due to the customary use of the goods during the right of withdrawal.
