Architectural works, which are an important part of our historical and cultural heritage, are of great importance not only in terms of aesthetics but also in terms of preserving the memory and identity of the society. Therefore, protecting these works and passing them on to future generations is a national and international responsibility.

Preserving architectural works does not only mean preserving the physical structure of the building. The historical, cultural and aesthetic values of the work must also be protected. In this context, various legal regulations and conservation programs exist for the protection of architectural works.

Preservation of Architectural Works in Turkey

The main legal regulation regarding the protection of architectural works in Turkey is the Law on Intellectual and Artistic Works (FSEK). This law accepts architectural works as “works” and grants a number of rights to the owner of the work. These rights include material rights such as reproduction, dissemination, representation, communication to the public and processing of the work, and moral rights such as protecting the integrity of the work and preventing changes to the work.

In addition to FSEK, other legal regulations regarding the protection of architectural works include legislation such as the Law on the Protection of Cultural and Natural Assets, the Monuments Regulation and the Urban Protected Areas Regulation.

Rights of the Author

The owner of the architectural work has a number of rights recognized by FSEK. These rights are:

Right to protect the integrity of the work: The author has the right to protect the integrity of his work and prevent changes to be made to the work.
Right to indicate his/her name on the work: The author has the right to indicate his/her name on or next to his/her work.
The right to make the work available to the public: The author has the right to decide when and how his work will be made available to the public.
The right to receive a fee for the use of the work: The author has the right to receive a fee from people who benefit from his work.
