In a right of way lawsuit, if the immovable property suitable for the establishment of the right of way is located on a parcel outside the lawsuit, a separate lawsuit must be filed against the owner of this parcel. The right of way can be established not only on the immovable property in question but also on all the convenient immovable properties needed. However, in order to request a right of way on a real property outside the lawsuit, the owner of this immovable property must also be included in the lawsuit. Therefore, in order to expand the right of way or establish it on another parcel, a new lawsuit must be filed against the owner of the relevant parcel or this person must be included in the lawsuit in the current lawsuit. Otherwise, the right of way will remain incomplete and the demand will not be fully met.
