Duties of Consumer Courts
Consumer Courts deal with disputes arising from consumer transactions and consumer-oriented practices within the scope of Law No. 6502 on Consumer Protection. Some examples of these disputes are as follows:
Disputes arising from defective goods or services
Disputes regarding the return or refund of purchased goods
Disputes arising from consumer credit or financial transactions
Disputes arising from sales made through distance selling or door-to-door sales
Disputes arising from unfair advertising or announcements
Application to Consumer Courts
Consumers can first apply to the seller or service provider regarding the dispute they experience and request that the problem be resolved. If no solution can be found on this issue or if the seller/service provider gives a negative response, consumers can apply to the Consumer Courts.
A petition must be prepared for application to the Consumer Courts and this petition must be submitted to the court with the necessary documents. The subject of the dispute, the parties, the requests and the evidence must be clearly stated in the petition.
Procedure of Cases in Consumer Courts
Case cases are heard in written form in Consumer Courts. After the case is filed, the court sends notice to the parties and a hearing date is determined. In the hearing, the parties and their lawyers present their oral statements and present their evidence. The court makes a decision after evaluating all the evidence.
Objection to Decisions in Consumer Courts
An objection to the decisions of the Consumer Courts can be appealed to the Court of Appeal within 15 days. The decision given by the Court of Appeal is final.
