How Long Does a Person Sentenced to 18 Years for Drugs Serve?
Drug crimes are subject to serious legal regulations both in our country and around the world. Crimes such as drug trafficking, use and production can result in severe penalties in legal systems. So, how long does a person sentenced to 18 years for drug crimes stay in prison? The answer to this question depends not only on the type and conditions of the sentence, but also on the penal system and early release practices in Turkey.
1. Drug Crimes and Penal Code
According to the Turkish Penal Code (TCK), crimes such as drug trafficking, possession or use of drugs are divided into different crime categories. Drug trafficking is a much more serious crime than other drug crimes, and penalties can be higher accordingly.
A person sentenced to 18 years for drug trafficking may have been sentenced to the crime of “trading in narcotics or stimulants” according to Article 188 of the TCK. This crime is considered a serious crime that threatens public health.
2. Sentence Length and Execution Reduction
If a person is sentenced to 18 years, whether or not they will serve their entire sentence depends on certain legal regulations and execution laws. In Turkey, those convicted of certain crimes can receive reductions in their sentence lengths if they are in good behavior and under certain conditions.
Good Conduct Reduction
According to the Turkish Penal Code, prisoners who show good behavior in prison can receive reductions in their sentence lengths by complying with certain conditions. This reduction is made at a certain rate for each year. In drug crimes, a reduction of 1/3 can be made for early execution of the sentence. In this case, a person sentenced to 18 years can serve this sentence for approximately 12 years with good behavior.
Supervised Release and Early Release
In Turkey, prisoners who have spent more than a certain period in prison can benefit from supervised release. In particular, criminals who have served two-thirds of their sentences can benefit from probation and be released early from prison if they are good at it. However, those convicted of serious crimes such as drug trafficking have a harder time benefiting from such early release practices.
Amnesty Laws and Exceptions
Sometimes, governments can shorten or completely cancel the sentences of prisoners convicted of certain crimes by enacting amnesty laws. However, it is more difficult for people convicted of drug crimes to benefit from such amnesties. Nevertheless, if amnesty laws are enacted, their sentences can be significantly shortened.
3. Calculation of Sentence Length
For a person sentenced to 18 years for drug crimes, the sentence length can change significantly in line with various reductions and conditions instead of the entire sentence. Practices such as good conduct reductions and probation can affect the length of the sentence. However, in general, a person sentenced to 18 years can serve two-thirds of their sentence in prison. In other words, they can be expected to remain in prison for 12 years.
4. Prevention of Drug Crimes and Legal Framework
Drug crimes are not limited to criminal consequences, but also have long-term effects on society. For this reason, penalties for drug crimes are quite harsh in our legal system. However, it should not be forgotten that rehabilitation and educational programs are as important as the deterrent effect of the penalties.
In the fight against drug crimes, it is not only necessary to impose punishments, but also to effectively implement rehabilitation processes so that criminals can be reintegrated into society.
A person sentenced to 18 years for drug use determines the time he or she will spend in prison depending on many factors. The sentence can be shortened with practices such as good behavior reduction and supervised release. However, in drug crimes, where penalties are generally severe, the convict is expected to spend a large portion of his or her sentence in prison.
