WHAT IS COVERAGE?

What is custody? The definition of custody is not clearly defined in the Turkish Civil Code. According to an opinion in the doctrine, custody is the authority given to the parents by the legislator in order to take the necessary decisions regarding the adult children who are not adults or exceptionally restricted. Another view is the right granted to parents by the legislator in order to make the child gain independence and to be able to manage and protect himself in time.

RESPONSIBILITIES OF GUARDIAN AND PARENT’S RIGHTS

The mother and / or father who have the right to custody also have obligations that must be fulfilled. The child should take and implement the necessary decisions, taking into account the interests of the child in his needs such as care and education. In addition, the maintenance debt of the parents continues until the child becomes adult, but if the child receives education after adulthood, the maintenance debt will continue until the education ends. Here, too, alimony comes into play.
In accordance with the general provisions regarding custody in the Turkish Civil Code, parents take decisions regarding the education and care of the child, taking into account the interests of the child. It takes all kinds of measures for the child’s physical, mental, moral and social development. The mother and father also represent the child against third parties within the framework of their custody.
