The right to annual paid leave is for the purpose of allowing workers to rest without loss of income. It has been accepted under the title of “Working conditions and the right to rest” in Article 50 of the Constitution and its regulation is a fundamental right left to the law. Annual leave fee is regulated under the title of “annual paid leave right” in the Labor Law No. 4857.
The right to annual paid leave is a personal right. Since the right to annual paid leave is a personal right, it cannot be transferred to another person. It is not possible to seize this right.
Annual leave wage is calculated over the last bare gross wage of the worker. Gross wage; It is the total amount found by adding insurance premiums, taxes and all kinds of deductions made by the state to the worker’s salary. The worker’s last gross wage is calculated by dividing by days and multiplying by the number of days he has annual leave. This wage must be paid to the worker in advance.
